आयकर ऐन, २०५८ को दफा १०१(४) को समय सीमालाई आधार लिएर विभागले पुनः संशोधित कर निर्धारण गर्दा यो यसरी जालसाजी गरी विवरण राखेको यो मितिमा यस कारणबाट थाहा हुन आएको हो भनी जालसाजीको पर्याप्त आधार कारण निर्णयमा खुलाउनु पर्ने हुन्छ। कर प्रशासन कार्यालय अर्धन्यायिक प्रकृतिको निकाय रहेकाले आफ्नो निर्णयमा प्राकृतिक न्यायको मान्य सिद्धान्त अन्तरगत न्यायोचित आधार कारण सहितको निर्णय गर्नुपर्ने हुन्छ। (para 23)
दफाहरु ८१(२) र दफा १०१ लाई तादाम्यत गरी हेर्दा संशोधित कर निर्धारणको निमित्त आवश्यक प्रमाणको उपलव्धता र पर्याप्तासमेतलाई ध्यानमा राखी करदाताले कागजात सम्बन्धी अभिलेख ५ वर्षसम्म राख्नुपर्ने विधायिकी मनसाय रहेको देखिन्छ। प्रमाणको उपलब्धता तथा पर्याप्तताको रोहमा उक्त दफा १०१(२) मा रहेको “जतिपटक पनि” भन्ने वाक्यांशले अनन्तकालसम्म समयसीमा विहिन र दफा १०१(४) मा रहेको “जालसाजीको जानकारी प्राप्त भएको १ वर्ष भित्र” भन्ने वाक्यांशले जहिलेसुकै जालसाजीको जानकारी पाएपनि सोही मितिबाट १ वर्षको समयसीमा कायम हुने भन्ने विधायिकी मनसाय रहेको मान्न मिल्ने देखिंदैन।(para 23)
संशोधित कर निर्धारण गर्ने अधिकार आयकर ऐन, २०५८ ले आन्तरिक राजस्व विभागलाई अख्तियार गरी समयसीमा समेत निर्धारण गरेको अवस्थामा कानून प्रदत्त समयसीमालाई वेवास्ता गरी जहिलेसुकै अधिकार प्रयोग गर्न मिल्ने हुँदैन। सामान्य समयसीमा र विशेष समयसीमा कानूनले नै तोकेको अवस्थामा सामान्य परिस्थिति र विशेष परिस्थितिमा अख्तियारी प्रयोग गर्ने आन्तरिक राजस्व विभागले पुनः संशोधित कर निर्धारणको न्यायोचित कारण निर्णयमा निर्णयाधार बनाउन सक्नुपर्ने हुन्छ।(para 24)
While carrying out amended assessment based on the time limit of Section 101(4) of the Income Tax Act, 2058 BS, the department should disclose sufficient grounds for the fraud in the decision stating that it has come to light on this date that the details were filed fraudulently. When Sections 81(2) and 101 are read together, it appears that the legislative intention is that the taxpayer should maintain the documentary record for 5 years, taking into account the availability and sufficiency of evidence required for the purpose of the amended tax assessment. In the light of the availability and sufficiency of evidence, the phrase “as many times” in Section 101(2) does not imply an indefinite period of time and the phrase “within 1 year of receipt of information of fraud” in Section 101(4) does not imply a legislative intention that the time limit of 1 year shall be imposed from the date of receipt of information of fraud whenever such information is received. In a situation where the Income Tax Act, 2058 BS has delegated the power to the Inland Revenue Department to assess revised tax and has also set a time limit, the authority cannot be exercised at any time, ignoring the time limit provided by law. In a situation where the general time limit and special time limit are prescribed by law, the Inland Revenue Department, which exercises its authority in general and special circumstances, should be able to base its decision on the justifiable reasons for the amended tax assessment.
